Intellectual Property Rights Policy

Mallcas respects the intellectual property rights of others and expects users of our website, products, and services to do the same. This Intellectual Property Rights Policy explains the ownership and permitted use of content available on Mallcas.com (the “Site”), as well as our procedures for addressing intellectual property concerns.

1. Ownership of Mallcas Content
Unless otherwise indicated, the Site and its original content, including but not limited to the Mallcas name and logos, product descriptions, product photographs, graphics, illustrations, designs, layouts, videos, text, icons, website elements, and other materials created or owned by Mallcas (collectively, “Mallcas Content”), are owned by or licensed to Mallcas and are protected by applicable copyright, trademark, and other intellectual property laws.

No Mallcas Content may be copied, reproduced, republished, modified, distributed, transmitted, displayed, sold, licensed, commercially exploited, or otherwise used without prior written authorization from Mallcas, except as permitted by applicable law.

Access to the Site does not grant users any ownership interest or intellectual property rights in Mallcas Content.

2. Mallcas Trademarks
The Mallcas name, logos, product names, branding elements, slogans, graphics, and other identifiers used by Mallcas may constitute trademarks, service marks, trade names, or other proprietary identifiers owned by or licensed to Mallcas.

Nothing on the Site should be interpreted as granting, by implication, estoppel, or otherwise, any license or right to use any Mallcas trademark without our prior written permission.

Unauthorized use of Mallcas trademarks in a manner that may cause confusion regarding affiliation, sponsorship, endorsement, or the source of products or services is prohibited.

3. Third-Party Trademarks and Vehicle Brands
The Site may display or reference third-party trademarks, vehicle manufacturer names, model names, logos, photographs, or other proprietary materials for purposes such as product illustration, compatibility information, customer showcases, installation examples, or identification of vehicles on which Mallcas products may be used.

All third-party trademarks, vehicle brands, logos, model names, and other proprietary materials remain the property of their respective owners.

Unless expressly stated otherwise, Mallcas is not affiliated with, sponsored by, authorized by, endorsed by, or officially connected with any vehicle manufacturer or other third-party trademark owner referenced on the Site.

References to third-party brands or vehicles are intended solely to identify, describe, or demonstrate the application or compatibility of Mallcas products.

4. Third-Party Images and Content
Certain photographs, videos, graphics, customer submissions, social media content, vehicle images, or other materials displayed on the Site may belong to customers, photographers, vehicle owners, manufacturers, creators, licensors, or other third parties.

Mallcas does not claim ownership of third-party intellectual property.

Where third-party content is used, Mallcas endeavors to use such content with appropriate permission, license, attribution, or other lawful basis where required.

If you are the owner or authorized representative of intellectual property displayed on the Site and believe that it has been used improperly, please contact us using the procedure described below.

5. Customer Photos, Reviews, and Submitted Content
Users may submit photographs, videos, reviews, comments, designs, or other content to Mallcas through the Site, email, social media, or other communication channels.

By voluntarily submitting such content to Mallcas for publication, promotion, review, or display, you represent that you own the content or have sufficient rights and permissions to provide it to us.

To the extent permitted by applicable law, you grant Mallcas a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, display, adapt, publish, and distribute the submitted content, in whole or in part, for purposes related to operating, marketing, and promoting Mallcas, its products, and its services.

You remain solely responsible for ensuring that any content you submit does not infringe the copyright, trademark, privacy, publicity, or other rights of any third party or otherwise violate applicable law.

6. Custom Designs and User-Provided Materials
Mallcas may offer personalized or custom vinyl wrap products that allow customers to provide images, artwork, logos, text, characters, graphics, photographs, or other materials for printing or production.

By submitting materials for a custom order, you represent and warrant that:

you own the submitted materials or have obtained all necessary permissions, licenses, or authorizations to use them;

the production and use of the requested design will not infringe any third party's copyright, trademark, right of publicity, privacy right, or other intellectual property or proprietary right; and

your requested design does not otherwise violate applicable law.

Mallcas reserves the right, but is not obligated, to reject, suspend, or cancel a custom order if we reasonably believe that the submitted materials may infringe third-party rights or violate applicable law.

Acceptance or production of a custom order by Mallcas does not constitute a determination or representation that the submitted materials are legally authorized for use.

The customer remains responsible for obtaining any necessary rights or permissions for customer-provided materials.

7. Prohibited Use of Site Content
Without prior written authorization, users may not:

reproduce or commercially distribute Mallcas product photographs, videos, graphics, or original designs;

use Mallcas trademarks, logos, or branding in a manner that falsely suggests affiliation, authorization, sponsorship, or endorsement;

remove or alter copyright, trademark, watermark, or proprietary notices appearing on Site content;

reproduce substantial portions of the Site for another commercial website, marketplace listing, catalog, or competing business;

create unauthorized derivative works from Mallcas-owned content; or

use Mallcas Content in any manner that violates applicable intellectual property laws.

Nothing in this Policy is intended to restrict uses that are independently permitted under applicable law.

8. Intellectual Property Infringement Complaints
Mallcas respects valid intellectual property rights and will review good-faith complaints regarding allegedly infringing material appearing on the Site.

If you believe that content available on the Site infringes intellectual property rights that you own or are authorized to enforce, please send a written notice to:

To help us investigate your request efficiently, please include:

Your full name and contact information;

Identification of the copyrighted work, trademark, or other intellectual property you believe has been infringed;

Identification and URL of the allegedly infringing material on the Site;

An explanation of your ownership or authority to act on behalf of the intellectual property owner;

A description of why you believe the use is unauthorized or infringing;

Supporting documentation, where available; and

A statement that the information provided in your notice is accurate and submitted in good faith.

We may request additional information reasonably necessary to evaluate the complaint.

9. Removal or Modification of Content
Upon receiving a sufficiently detailed intellectual property complaint, Mallcas may investigate the matter and, where appropriate, remove, disable, replace, or modify the disputed content.

Submitting a complaint does not automatically establish infringement, and Mallcas reserves the right to evaluate claims based on the information provided and applicable law. Mallcas may, in appropriate circumstances and in its sole discretion, terminate or disable the accounts of users who are determined to be repeat infringers of intellectual property rights.

Where appropriate, we may also contact the party who supplied the disputed material to request additional information.

10. Misrepresentation and Abuse of Complaints
Intellectual property complaints should be submitted in good faith.

A person submitting a complaint is responsible for the accuracy of the information provided and should not knowingly make false or misleading claims regarding ownership, authorization, or alleged infringement.

Mallcas reserves the right to decline or discontinue processing complaints that appear fraudulent, abusive, materially incomplete, or unrelated to legitimate intellectual property concerns.

11. No Transfer of Intellectual Property Rights
Purchasing a Mallcas product does not transfer ownership of any copyright, trademark, design right, or other intellectual property associated with Mallcas or third-party content incorporated into or displayed in connection with that product.

Any rights granted to customers are limited to the ownership and lawful use of the physical products purchased, unless otherwise expressly agreed in writing.

12. Changes to This Policy
Mallcas may update this Intellectual Property Rights Policy from time to time to reflect changes in our services, business practices, or applicable legal requirements.

Any revised version will become effective when posted on the Site, unless otherwise stated.
